Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) govern access to and use of the BookMyPhotog website and related services (the “Service”). BookMyPhotog is operated by Luke Fuhrman (“BookMyPhotog,” “we,” “us,” or “our”).

By creating an account, submitting a booking request (including as a guest), publishing a photographer profile, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and account responsibility

You must be at least 18 years old and able to form a binding contract to create an account or submit a booking request. You are responsible for the information you provide, for keeping your login credentials confidential, and for activity that occurs under your account. Notify us promptly if you believe your account has been misused.

3. Customer accounts and guest booking requests

Customers may create an account to track booking requests submitted while signed in. Customers may also submit booking requests as a guest without an account. Guest requests are still subject to these Terms. Guest requests made before you create an account are not automatically linked to a later customer account.

4. Photographer profiles and responsibilities

Photographers may create and manage a profile, including business name, bio, location and travel preferences, specialties and styles, portfolio images, packages or services, pricing they choose to list, availability notes, weekly availability, and blocked dates. Photographers decide whether to publish a profile so customers can find it.

You are solely responsible for your profile content, the photography services you offer, your availability, listed prices, communications with customers, and any work you perform. Photographers are independent users and service providers. They are not employees, agents, or partners of BookMyPhotog.

5. Booking requests

BookMyPhotog helps customers discover photographers and submit booking requests. A request may include a requested date, a selected package or service, contact details, a message, and related information the form collects. Photographers may accept or decline requests through the Service.

Submitting or accepting a request does not guarantee that a shoot will occur, that a photographer is available, that listed prices will apply, or that either party will complete a transaction. BookMyPhotog does not guarantee a match, a booking, service quality, or a successful outcome.

6. Payments (current beta)

BookMyPhotog does not currently process payments between customers and photographers. During this beta, payment for photography services is arranged separately between the photographer and the customer, off the BookMyPhotog platform. We do not collect photography-service fees, deposits, refunds, or cancellation fees through the Service today, and we do not operate a BookMyPhotog payment checkout for those services.

7. Independent relationship

Any agreement for photography services is solely between the photographer and the customer. BookMyPhotog is not a party to that agreement and is not responsible for photography services, shoot conduct, deliverables, licensing of finished photos between those parties, or off-platform payment disputes.

8. Content ownership and license to display

You retain ownership of content you upload, including profile photos and portfolio images. You represent that you have the rights needed to upload that content and to grant the license below, including permission from identifiable people where required.

You grant BookMyPhotog a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content on the Service so we can operate the marketplace (for example, showing a published profile and portfolio to visitors). This license lasts while the content remains on the Service. Removing content or unpublishing a profile stops new public display through the Service, except for copies already cached or reasonably needed for backups, security, or legal purposes.

9. Acceptable and prohibited use

You agree not to:

• use the Service for unlawful, fraudulent, or harmful purposes;
• impersonate others or misrepresent your identity, listings, or availability;
• upload content you do not have the right to use, including infringing images;
• harass, spam, or scrape the Service, or interfere with its security or operation;
• attempt to access another user’s account or non-public data;
• use the Service to offer illegal services or to exploit minors.

10. Accuracy of listings, pricing, and availability

Photographers must keep profile information, packages, prices, and availability reasonably accurate. Customers should verify details directly with the photographer. Information on the Service may be incomplete, outdated, or incorrect. BookMyPhotog does not verify every listing and does not warrant accuracy.

11. Communications and transactional emails

We may send transactional messages related to your account and booking requests, including in-app notifications and emails (for example, when a request is sent, accepted, declined, or cancelled). These messages are part of operating the Service.

12. Cancellations and disputes

Photographers and customers may update request status through the Service where that functionality is provided (for example, accept, decline, or cancel). Cancellation policies, refunds, rescheduling, and quality disputes for photography work are between the photographer and the customer. BookMyPhotog is not a payment processor for those services and does not adjudicate or guarantee resolution of those disputes.

13. BookMyPhotog’s marketplace role

BookMyPhotog provides a platform for discovery, profiles, and booking requests. We do not provide photography services, employ photographers, or control how photographers perform their work. We may moderate content or suspend access as described below, but we are not obligated to monitor all user activity.

14. Beta availability and changes

The Service is in beta. Features may change, break, or be withdrawn. We do not guarantee uninterrupted or error-free operation, and we may perform maintenance or modify the Service at any time.

15. Future paid features

BookMyPhotog may later introduce paid features, platform fees, or in-platform payments. We will not charge you for a new paid feature without providing notice and updated terms or checkout information at that time. These beta Terms do not create any current subscription, booking fee, or refund policy for photography services.

16. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if we believe your use creates risk or harm, or if we discontinue the Service. We may also remove content that appears unlawful or that violates these Terms.

17. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKMYPHOTOG DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE OR THAT ANY PHOTOGRAPHER, BOOKING, OR TRANSACTION WILL BE SATISFACTORY OR COMPLETED.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOKMYPHOTOG, LUKE FUHRMAN, AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR FROM ANY DEALINGS BETWEEN PHOTOGRAPHERS AND CUSTOMERS.

BookMyPhotog is currently offered as a free beta and does not charge platform fees for use of the Service. To the maximum extent permitted by applicable law, our aggregate liability for any claim relating to the Service is limited accordingly. These limitations do not apply to liability that applicable law does not allow to be limited or excluded, including mandatory consumer protections or other non-waivable rights. Where a limitation is not permitted, our liability is limited to the fullest extent that applicable law does allow.

19. Indemnification

You agree to defend, indemnify, and hold harmless BookMyPhotog from claims, damages, losses, and reasonable expenses (including attorneys’ fees) arising out of your content, your use of the Service, your photography services or booking arrangements, or your violation of these Terms or of another person’s rights.

20. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the date above. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the Service.

21. Governing law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law rules, except that mandatory consumer-protection laws or other rights that cannot legally be waived in your place of residence will continue to apply. Selecting Indiana law does not limit where BookMyPhotog may operate or where you may live or use the Service. If a court proceeding is necessary, it may be brought in a court of competent jurisdiction, which may include courts located in Indiana, unless applicable law requires another forum.
